Notice is hereby given that the City Council will go into Executive Session in accordance with the following provisions of the Tax Code: Sec. 321.3022 to receive information or question employees or third parties regarding information received from the comptroller relating to sales taxes; and the Government Code: Sec. 551.071(1)(A) pending or contemplated litigation; 551.071(1)(B) a settlement offer; Sec. 551.071(2) an attorney-client privilege/relationship; Sec. 551.072 the purchase, exchange, lease, or value of real property; Sec. 551.073 a gift and/or donation; 551.074(a)(1) the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a city officer or employee including City Council Members, the City Manager, City Secretary, City Attorney, and Municipal Judge; Sec. 551.074 (a)(2) to hear a complaint or charge against a city officer or employee; and Sec. 551.076 the deployment or specific occasions for implementation of security personnel or devices; 551.087(1) to discuss commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the City of Waco with which the City is conducting economic development negotiations; Sec. 551.087(2) to discuss the offer of a financial or other incentive to a business prospect that the City seeks to have locate, stay, or expand in or near the City of Waco; Sec. 551.088 to discuss a test item or information related to a test item.

The City Council may go into Executive Session on any item listed on the Agenda in accordance with Chapter 551 of the Government Code.

8. RES-832 Consider approval of a resolution authorizing the City Manager to renew an agreement with The Hartford TAGCO to provide Medicare Supplement Benefits to retirees and the execution of any documents necessary in connection therewith.

RES-833 Consider approval of a resolution approving a loan commitment in an amount not to exceed $300,000.00 to NRP Group LLC and/or Costa Esmeralda, LTD, subject to NRP Group LLC and/or Costa Esmeralda, LTD, successfully receiving an allocation of Low Income Housing Tax Credits from the Texas Department of Housing and Community Affairs that meets commitment conditions of the City of Waco, and further authorizing the City Manager to execute any and all legal documents necessary for the loan commitment.

RES-834 Consider approval of a resolution authorizing the revision of the duties of the Waco Transportation Committee to include the consideration of traffic engineering studies and recommendation of appropriate intersections for the installation of photographic traffic signal enforcement systems within the City of Waco and the revision of the membership of the Waco Transportation Committee to include six (6) members: with each member appointed by a different member of the City Council.

RES-836 Consider approval of a resolution to sell, as is, Lot 10, Block 87, Farwell Heights Addition, known as 2115 Herring, Waco, Texas, to Concepcion Lopez, adjoining property owner, in an amount not to exceed $406.50, and to authorize the City Manager to execute all necessary documents in connection with the sale.

RES-837 Consider approval of a resolution accepting a donation of real property, from the Waco Family Practice Foundation, described as Lot Five (5) in Block One (1) of the Family Practice Center Addition, to the City of Waco, McLennan County, Texas, as per final plat recorded as Instrument #2006030187 of the Official Public Records of McLennan County, Texas, and accepting the donation of the new building for South Waco Library which has been built on the property by Mr. Malcolm Duncan, Sr. and which he is donating to the City of Waco, contingent upon receipt of acceptable title documentation for the real property and contingent upon receipt of all necessary building inspection approvals and further authorizing the City Manager to execute all documents necessary to complete this transaction.

RES-838 Consider approval of a resolution authorizing the City Manager to award a 36-month supply contract to: Chameleon Industries Inc., Mesquite, TX (Liquid Aluminum Sulfate and Polymer Blend without Copper CI-3204), Harcros Chemicals, Inc., Dallas, TX (Fluorosilicic Acid), DPC Industries, Cleburne, TX (Sulfur Dioxide 1-ton cylinders, Liquid Chlorine 1-ton and 150-lbs. cylinders), Skyhawk Chemicals, Inc., Houston, TX (Sodium Hydroxide 25% concentration), Fluid Solution Technology Inc., Manor, TX (50% concentration), Norit Americas Incorporated, Marshall, Texas (Powdered Activated Carbon) and authorizing the expenditures in an annual amount not to exceed $850,345.00 for the Water Treatment Plants and $309,800.00 for the Waco Metropolitan Area Regional Sewer System for FY07-08.

RES-839 Consider approval of a resolution authorizing the award of a contract to H & B Contractors, Inc., McGregor, Texas, lowest and best responsible bidder, for water improvements by Andy Horn, for Central Professional Park - Water Improvements, in an amount not to exceed $197,687.76 and the City Manager is hereby authorized to execute a contract with Andy Horn, for partial refund of such improvements on a timely basis, in an amount not to exceed $165,852.76.

16. RES-840 Consider approval of a resolution authorizing the City Manager to execute an engineering services agreement with Freese and Nichols, Inc., Fort Worth, Texas to design the Martin Luther King Jr. Sanitary Sewer Line Rehabilitation Project in an amount not to exceed $110,170.00.

RES-841 Consider approval of a resolution authorizing the City Manager to execute an amended Construction Consulting Services Agreement for the Waco Metropolitan Area Regional Sewer System (WMARSS) with R.W. Beck, Inc., Richardson, Texas in partnership with CDM, Inc., Austin, Texas in the amount of $338,585.00 so that the total amount does not exceed $2,730,934.00.

18. RES-842 Consider approval of a resolution confirming the appointment of Brent E. Stroman as Police Chief for the City of Waco, Texas.

19. RES-843 Consider approval of a resolution authorizing the City Manager to utilize the competitive sealed proposal procedure for the purchase of excess workers' compensation insurance because this method provides the best value for the City of Waco.

ECONOMIC DEVELOPMENT

20. RES-844 Consider approval of a resolution authorizing the City Manager to execute a Program Project Agreement with L-3 Communications Integrated Systems, L.P. in an amount not to exceed $300,000.00 through the Waco McLennan County Economic Development Corporation ($150,000.00 of which will be provided by the City of Waco) in exchange for the creation of 100 new full-time jobs in Waco, McLennan County, Texas.
