Notice is hereby given that the City Council will go into Executive Session in accordance with the following provisions of the Tax Code: Sec. 321.3022 to receive information or question employees or third parties regarding information received from the comptroller relating to sales taxes; and the Government Code:  Sec. 551.071(1)(A) pending or contemplated litigation; 551.071(1)(B) a settlement offer; Sec. 551.071(2) an attorney-client privilege/relationship; Sec. 551.072 the purchase, exchange, lease, or value of real property; Sec. 551.073 a gift and/or donation; 551.074(a)(1) the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a city officer or employee including City Council Members, the City Manager, City Secretary, City Attorney, and Municipal Judge; Sec. 551.074 (a)(2) to hear a complaint or charge against a city officer or employee; and Sec. 551.076 the deployment or specific occasions for implementation of security personnel or devices; 551.087(1) to discuss commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the City of Waco with which the City is conducting economic development negotiations;  Sec. 551.087(2) to discuss the offer of a financial or other incentive to a business prospect that the City seeks to have locate, stay, or expand in or near the City of Waco; Sec. 551.088 to discuss a test item or information related to a test item.

2. RES-327 Consider approval of a resolution rejecting the single bid of H & B Contractors Inc., Waco, Texas, in the amount of $550,928.08, for the Traffic Calming and Drainage at Various Locations 2008-1 project.

RES-328 Consider approval of a resolution authorizing the City Manager to execute a contract with Durable Specialties, Inc., Duncanville, Texas, for construction of new traffic signals at (1) Cobbs Drive and Fishpond Road, and at (2) China Spring Highway (FM 1637) and Flat Rock Road, in the amount not to exceed $99,000.00.

4. RES-329 Consider approval of a resolution authorizing the City Manager to renew a contract with Blue Cross Blue Shield of Texas, Dallas, Texas, for an additional one-year term, for the purpose of providing third party administrative (TPA) services and individual and aggregate stop loss coverage for a self-funded health and prescription insurance plan in an amount not to exceed $900,000.00 for FY 2008-09, and authorizing the City Manager to execute any other documents necessary in connection therewith.

5. RES-330 Consider approval of a resolution authorizing the City Manager to execute renewal agreements with Prudential Insurance Company of America, Roseland, New Jersey, for an additional one (1) year term, for the following:  (1) an agreement for the purpose of providing long-term disability insurance to the City of Waco, in an amount not to exceed $84,000.00; and (2) an agreement for the purpose of providing short-term disability insurance to City employees, and authorizing the City Manager to execute any other documents necessary in connection therewith.

RES-331 Consider approval of a resolution awarding a contract to Prudential Insurance Company of America, Roseland, New Jersey, with a term of one year with two one-year options to renew for the purpose of providing group life and accidental death and dismemberment insurance for City of Waco employees and retirees in an amount not to exceed $95,000.00 per fiscal year and authorizing the City Manager to execute all documents necessary to complete this transaction.

RES-332 Consider approval of a resolution authorizing the City Manager to execute a renewal agreement with United Healthcare Specialty Benefits, Golden Valley, Minnesota, for a term of one (1) year, to provide voluntary vision insurance benefits to City employees, and authorizing the City Manager to execute any other documents necessary in connection therewith.

RES-333 Consider approval of a resolution authorizing the City Manager to execute a renewal agreement with QCD of America, Dallas, Texas, for an additional one (1) year term, to provide voluntary dental and vision discount benefits to City employees, authorizing the City Manager to execute a renewal agreement with SafeGuard Life Insurance Company, Aliso Viejo, California, for an additional one (1) year term, to provide voluntary dental insurance benefits to City employees, and authorizing the City Manager to execute any other documents necessary in connection therewith.

RES-334 Consider approval of a resolution to amend the New Acquisition and the Rehabilitation/ Reconstruction Programs to prohibit loans under such programs to applicants owning real estate property during the past twelve months from the date of loan application, subject to review and waiver by the City of Waco loan committee.

RES-335 Consider approval of a resolution approving the assignment of rights and benefits of Edanbra Development, L.C., to Joe and Carmen Benavides, under an Agreement for Residential Tax Abatement between Edanbra Development, L.C., and the City of Waco for property located at 2325 Los Arboles, Block 2, Lot 16, The Woods at Kendrick Lane, in the City of Waco.

11. RES-336 Consider approval of a resolution authorizing the City Manager to submit and accept an Edward Byrne Memorial Justice Assistance Grant (JAG) from the U.S. Department of Justice, Bureau of Justice Assistance, in the amount of $32,649.00 to be used to reduce crime and improve public safety, and to authorize the City Manager to accept said grant and execute any document in connection therewith and/or furnish additional information/documentation as is deemed necessary for implementation of said program and related matters.

RES-337 Consider approval of a resolution authorizing the City Manager to accept a grant from the Texas Department of Transportation in an amount not to exceed $50,000.00 for the FY2008 Routine Airport Maintenance Program and to authorize the City Manager to execute any grant documents in connection therewith, and/or furnish additional information/documentation as may be deemed necessary for the implementation of said program.

1.  RES-343  Consider approval of a resolution authorizing the City Manager to execute an amendment to the Waco McLennan County Economic Development Corporation Program Project Agreement entered into with Caterpillar Logistics Services, Inc. (RES 2007-089) to allow an extension of the current contract completion date for real and personal property improvements located at 600 General Parkway, Waco, Texas from June 2007 to June 2008, to allow a change to the job descriptions and corresponding pay-grades for the forty (40) full-time jobs to be created, and to allow a $900,000.00 net decrease in the real and personal property improvement investment amount at the 600 General Parkway Facility.
